Trademark Class 40
Services supplied by mechanical or chemical processing or modification of things or inorganic or organic substances are covered under Trademark Class 40. For categorization purposes, the mark is deemed a service mark only when processing or transformation is performed for the benefit of another person. In all circumstances when the material or product is marketed by the person who processed or altered it, the mark is considered a trade mark.
The following services are also included in Class 40:
1. Services relating to the transformation of an object or substance, as well as any process involving a change in its essential properties (for example, dyeing a garment); as a result, a maintenance service, which is normally classified in Class 37, is classified in Class 40 if such a change is involved (for example, the chroming of motor vehicle bumpers).
2. material treatment services that may be present throughout the manufacturing of any substance or item other than a structure, such as cutting, shaping, polishing by abrasion, or metal coating.
